Notice of Privacy Practices

This notice describes how health information about you may be used and shared, how you can obtain access to that information, and the responsibilities of Calm Shores Integrative Wellness. Please review it carefully.

You have rights over your health information, choices about certain uses and sharing, and the right to complain without retaliation. The practice must protect your information and explain its privacy duties.

• Get a copy of your health and claims records. You may ask to inspect or receive an electronic or paper copy. The practice will usually provide a copy or an agreed summary within 30 days of your request and may charge a reasonable, cost-based fee.
• Ask for a correction. You may ask the practice to correct health or claims information you believe is incorrect or incomplete. The practice may deny the request, but will explain why in writing within 60 days.
• Request confidential communications. You may ask the practice to contact you in a particular way or at a particular location. Reasonable requests will be honored.
• Ask for limits on use or sharing. You may ask the practice not to use or share certain health information for treatment, payment, or practice operations. The practice is not required to agree and may deny a request, for example, if it could affect your care. If the practice agrees, it may still share the information for emergency treatment. If you pay in full out of pocket for a service or item, you may ask that information about it not be shared with your health plan for payment or health care operations. The practice will honor that request unless disclosure is required by law.
• Get a list of certain disclosures. You may ask for an accounting of certain times your health information was shared, the recipient, and the reason for up to six years before your request. The accounting does not include every disclosure, such as those for treatment, payment, health care operations, or disclosures you requested. One accounting each year is free; a reasonable, cost-based fee may apply to additional requests within 12 months.
• Get another copy of this notice. You may request a paper copy at any time, even if you agreed to receive it electronically. The practice will provide it promptly.
• Choose someone to act for you. A person with medical power of attorney or a legal guardian may exercise your rights and make choices about your health information. The practice will confirm that the person has authority before acting.
• File a complaint. You may complain if you believe your privacy rights were violated. The practice will not retaliate against you for filing a complaint.

You may tell the practice whether to share information with family, close friends, or others involved in your care or payment; for disaster-relief efforts; or in a patient directory, if one applies. If you cannot state a preference, such as when you are unconscious, the practice may share information when it is in your best interest and permitted by law. Information may also be shared when needed to reduce a serious and imminent threat to health or safety.

• Written permission is required for marketing, sale of your health information, and most sharing of psychotherapy notes.
• If the practice contacts you about fundraising, you may choose not to receive future fundraising communications.

The practice may use or disclose health information to:

• Treat you and coordinate or manage your care.
• Run the practice, improve care, and contact you when needed.
• Bill for services and receive payment from health plans or others.
• Support public health and safety activities, including preventing disease, assisting with product recalls, reporting adverse reactions, reporting suspected abuse, neglect, or domestic violence, and preventing or reducing a serious threat.
• Conduct or support health research as permitted by law.
• Comply with the law, including requests from the U.S. Department of Health and Human Services to verify compliance with federal privacy law.
• Respond to organ and tissue donation organizations.
• Work with a medical examiner, coroner, or funeral director after a person dies.
• Address workers' compensation, law-enforcement, health-oversight, and special-government-function requests permitted by law, such as military, national-security, or presidential-protection functions.
• Respond to lawsuits and legal proceedings, including a court or administrative order or a lawful subpoena.

If the practice creates or maintains substance use disorder patient records protected by 42 C.F.R. Part 2, those records cannot be used or disclosed in a civil, criminal, administrative, or legislative investigation or proceeding against you without your written consent or a court order that meets Part 2 requirements together with a subpoena or other legal mandate.

If Part 2 records would be used for fundraising, the practice must tell you in advance and give you a clear opportunity not to receive fundraising communications.

Uses and disclosures not described in this notice require your written authorization unless the law permits otherwise. You may revoke an authorization in writing at any time. The revocation does not undo actions already taken in reliance on your authorization.

Calm Shores Integrative Wellness is required to:

• Maintain the privacy and security of protected health information.
• Provide this notice and follow the privacy practices described here.
• Notify you promptly following a breach that may have compromised the privacy or security of your information, as required by law.
• Obtain written permission before using or sharing information for a reason not covered by this notice, unless the law permits otherwise.

The practice may change this notice and make the revised terms apply to all health information it maintains, including information created or received before the change. The current notice will be available on this website and by request.

This website makes the current notice publicly available. Posting it here is not the complete notice-delivery or acknowledgment process. When required, CaelaraHealth or a separate practice workflow may handle delivery and acknowledgment.

You may also submit a complaint to the U.S. Department of Health and Human Services Office for Civil Rights through its official complaint information page. The practice will not retaliate against you for filing a complaint.
